Taiwan Child Custody Law

How Do Taiwan Courts Decide Child Custody?

Taiwan courts determine the exercise of parental rights and responsibilities according to the best interests of the minor child. There is no single factor that automatically determines the outcome.

Factor 01

Stability & Continuity of Care

The court may consider the child's existing living environment, routine, education, relationships, and the potential impact of changing a stable caregiving arrangement.

Factor 02

Primary Caregiving

The history of who has actually cared for the child and participated in the child's daily life may be relevant to the overall assessment.

Factor 03

The Child's Wishes

Depending on the child's age and maturity, the child's views may be heard and given appropriate weight as part of the best-interests analysis.

Factor 04

Parenting Ability & Environment

The court may examine each parent's circumstances, willingness to care for the child, living situation, health, and ability to provide appropriate care.

Factor 05

Relationship With Each Parent

The emotional relationship between the child and each parent, as well as other people living with the child, may also be considered.

Factor 06

Cooperation Between Parents

Conduct that unnecessarily interferes with the child's relationship with the other parent may become relevant in the court's assessment.

Factor 07

Social Worker & Professional Reports

Depending on the case, the court may consider social-worker visitation reports or other professional information when evaluating the child's circumstances.

Factor 08

All Circumstances Affecting the Child

The best-interests standard is not a mechanical checklist. The court evaluates the relevant favorable and unfavorable factors in the circumstances of the individual child.

International Families

Does Being a Foreign Parent Put You at a Disadvantage?

Being a foreign parent does not, by itself, determine the outcome of a child custody case in Taiwan.

The central question remains what arrangement serves the child's best interests. In an international custody dispute, however, additional practical and legal considerations may become especially important.

In cross-border cases, stability matters. A proposed change in the child's country of residence may affect language, schooling, lifestyle, relationships, and the child's overall living environment.

Depending on the case, relevant issues may include the child's connection with Taiwan, the proposed country of residence, language and education, the continuity of the child's upbringing, and how the child can maintain a meaningful relationship with the other parent.

Understanding the Difference

Child Custody and Visitation Are Not the Same Thing

These concepts are closely related, but they address different legal and practical questions.

CHILD CUSTODY

Parental Rights & Responsibilities

Custody concerns who exercises parental rights and responsibilities and how important decisions affecting the minor child are made.

≠
VISITATION

Contact & Parenting Time

Visitation concerns how a parent maintains contact and spends time with the child when the parents are no longer living together.

Not being the parent who primarily exercises parental rights does not automatically mean losing the ability to maintain a relationship with the child. Visitation itself is also considered from the perspective of the child's interests.
Changing an Existing Arrangement

Can an Existing Custody Arrangement Be Changed?

A custody arrangement is not necessarily permanent. If an existing arrangement becomes unfavorable to the minor child, Taiwan law provides mechanisms through which a change may be requested.

The key question is not simply whether one parent prefers a different arrangement, but whether changing the current arrangement would better protect the child's interests.

Cross-Border Family Law

International & Cross-Border Child Custody

International custody disputes can raise issues beyond an ordinary disagreement between two parents living in Taiwan.

Foreign Parent

One or both parents are foreign nationals and need to understand their parental rights under Taiwan law.

Parent Living Overseas

One parent lives outside Taiwan, creating practical questions concerning proceedings, contact, and parenting arrangements.

International Relocation

One parent proposes moving the child to another country, potentially changing the child's school, language, and living environment.

Cross-Border Proceedings

Family proceedings, orders, or related legal issues may exist in Taiwan and another jurisdiction.

Our Approach

How We Approach a Child Custody Case

Custody litigation should begin with understanding the child's actual circumstances—not simply preparing accusations against the other parent.

01

Understand the Family

We first understand the child's current living arrangements, caregiving history, family relationships, and the existing dispute.

02

Identify the Legal Issues

We evaluate custody, visitation, modification, relocation, temporary measures, and other issues relevant to the case.

03

Evaluate the Evidence

We consider what evidence may help the court understand the child's circumstances and the proposed parenting arrangement.

04

Develop a Strategy

Depending on the situation, the appropriate path may involve negotiation, mediation, court proceedings, or an application for temporary relief.

Frequently Asked Questions

Child Custody in Taiwan

Can a foreign parent get child custody in Taiwan?
Being a foreign parent does not by itself determine the outcome. Taiwan courts focus on the best interests of the minor child and consider the circumstances relevant to the individual case. International cases may also require particular attention to residence, language, schooling, continuity of care, and possible relocation.
How does a Taiwan court decide child custody?
The court determines parental rights and responsibilities according to the child's best interests. Relevant considerations may include the child's circumstances and wishes, each parent's situation and caregiving ability, the child's relationship with each parent, continuity of care, and other factors affecting the child's welfare.
Does the mother automatically get custody in Taiwan?
No single factor automatically determines custody. The court must evaluate the circumstances of the individual child and determine the arrangement that best serves the child's interests.
Can parents have joint custody after divorce in Taiwan?
Parents may agree to continue jointly exercising parental rights and responsibilities after divorce. If they cannot reach an agreement, the court may determine the appropriate arrangement based on the child's interests.
Does the child's preference matter in a Taiwan custody case?
The child's views can be an important factor. The appropriate weight depends on matters such as the child's age, maturity, and ability to form and express an independent view. The child's preference is relevant but is not necessarily the only factor determining the outcome.
What happens if the other parent refuses visitation?
Visitation is considered not only from the perspective of the parent, but also from the child's interest in maintaining relationships with both parents. Depending on the existing arrangement and circumstances, court proceedings, enforcement, modification, or temporary measures may need to be considered.
Can child custody be changed after divorce?
Potentially, yes. If the existing exercise of parental rights and responsibilities becomes unfavorable to the minor child, a change may be requested. Whether modification is appropriate depends on the circumstances and the child's best interests.
Can one parent take the child out of Taiwan?
International relocation can raise significant custody and family-law issues. The legal analysis depends on the existing parental-rights arrangement, court orders, the proposed relocation, and the individual circumstances. Legal advice should be obtained before taking major cross-border action involving a child.
What if the other parent lives overseas?
A parent living overseas does not automatically prevent a custody or visitation matter from being handled in Taiwan. However, international jurisdiction, service, attendance, parenting arrangements, relocation, and proceedings in another country may require additional analysis.
