Insurance Coverage Disputes

Insurance litigation is not ordinary civil litigation.

When a substantial insurance claim is denied or reduced, the dispute rarely turns on a single sentence in the policy.

The real issues may involve how the policy should be interpreted, whether an exclusion actually applies, what caused the loss, whether sufficient evidence supports the claim, and whether the insurer's stated basis for denial can withstand legal scrutiny.

This is why experience specifically involving insurance claims and coverage litigation matters.

A claim denial is the insurance company's position. It is not a court judgment.

Before deciding that the claim is over, the policy, the underlying event, the insurer's reasoning, and the supporting evidence should be independently reviewed.
A Different Perspective

We understand how insurance disputes are evaluated from the insurer's side.

Before representing policyholders and clients in insurance disputes, Attorney Linda Yeh accumulated years of experience assisting insurance companies in claims disputes and litigation.

That experience provides an important perspective: understanding how insurers examine coverage, exclusions, causation, proof of loss, and litigation risk when deciding whether to pay, negotiate, or defend a claim.

When reviewing a denied claim, we ask:

01
What is the insurer actually relying on?

We identify the specific policy language, exclusion, factual allegation, or evidentiary issue behind the denial.

02
Does the policy support that interpretation?

Policy wording must be examined in context rather than accepting the insurer's interpretation at face value.

03
Can the factual assumptions be challenged?

Causation, loss calculations, medical facts, technical evidence, and expert conclusions may become central to coverage.

04
What evidence would actually matter in court?

We evaluate not only what happened, but how the facts can be proven through documents, witnesses, experts, and other evidence.

Common Insurance Disputes

Why was my insurance claim denied?

Many coverage disputes begin with one of three explanations. Each requires its own legal and factual analysis.

01

“This loss is not covered.”

The insurer may argue that the event does not fall within the policy's coverage. The policy wording and actual circumstances of the event must be examined together.

02

“A policy exclusion applies.”

The existence of an exclusion does not end the analysis. The scope, interpretation, and applicability of the exclusion must still be evaluated.

03

“You cannot prove causation.”

Coverage may depend on what actually caused the loss. Expert reports, medical evidence, technical evidence, or court-appointed appraisal may therefore become decisive.

Start With an Assessment

Before deciding whether to litigate, understand the strength of the claim.

Insurance litigation can involve significant time and cost. The first step should therefore be an objective assessment of the insurer's position, your evidence, and the practical value of pursuing the dispute.

01

Provide the Documents

Policy, denial letter, claim materials, records concerning the insured event, and important communications.

02

Legal Consultation

We discuss what happened, what the insurer is arguing, and what outcome you are seeking.

03

Case Assessment

We evaluate coverage, exclusions, causation, evidence, risks, and possible legal strategies.

04

Choose the Next Step

Negotiation, mediation, additional evidence, written legal action, or litigation may be considered depending on the case.

Common Questions

Insurance Claims in Taiwan

The insurance company denied my claim. Does that mean I cannot recover?
Not necessarily. A denial letter reflects the insurer's position, but it is not a court judgment. The policy language, stated reason for denial, facts of the insured event, and available evidence should be independently reviewed to determine whether the denial is legally and factually supportable.
The insurer offered only part of my claim. Can I seek more?
Possibly. Insurance disputes may involve both whether coverage exists and the amount that should be paid. The appropriate amount depends on the policy terms, nature of the loss, applicable coverage limits, and evidence supporting the claimed amount.
What should I bring to an insurance consultation?
We recommend providing the complete policy, policy application documents where relevant, your claim submission, the insurer's written response or denial letter, documents relating to the insured event, evidence of the loss, and important communications with the insurer.
The insurance company says I failed to disclose information. What should I do?
The issue requires closer examination. It is necessary to determine what questions were actually asked during the application process, what information was allegedly omitted, and whether the alleged non-disclosure legally affects the insurer's obligation to provide coverage in the particular case.
Do insurance disputes always need to go to court?
No. Depending on the facts, evidence, amount in dispute, and the insurer's position, negotiation, mediation, further claim review, or other approaches may be considered before or instead of litigation. The appropriate strategy should be evaluated on a case-by-case basis.
How long can insurance litigation take in Taiwan?
It depends on the complexity of the dispute, amount of evidence, court schedule, number of disputed issues, and whether expert appraisal is required. Complex insurance litigation may take one to two years or longer.
Can an overseas or foreign client consult you in English?
Yes. We provide English legal consultations for international and overseas clients. Documents may be provided electronically in advance, and the initial consultation can be conducted online where appropriate.

A claim denial does not have to be the end of the analysis.

Send us the insurance policy, denial letter, and key documents. We can review the insurer's position and help you understand the legal strength, practical risks, and possible next steps before you decide whether further action is worthwhile.
